LitFuel Terms of Services

LitFuel and associated sites were created as a medium for authors to connect with readers and for readers to have a place to find events, new reads, information, and more. As a company that strives to bring a community of readers together, one of our main goals is to create a positive experience for every Voyager (i.e., member). To do so, we’ve outlined Terms of Service for any ‘Lit’ site.

This Terms of Service is part of the larger scope of LitFuel policies, and by using LitFuel sites, you agree to our Terms of Service.

Welcome, Voyagers!

This LitFuel User Agreement ("Terms") applies to your access and use of the websites, mobile apps, and other online services (collectively, the "Services") provided by LitFuel, LLC ("LitFuel," "we," "us," or "our"), including LitFuel.com, LitFuel.co, and LitFuel.me (the "Sites").

LitFuel is a community for readers and authors to connect, discover new books, and engage in thoughtful discussions. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.  

1. Your Access to the Services  

  • Age Requirement: You must be at least 13 years old to use the Services. Some Services may have additional age requirements.
  • Legal Capacity: You must be able to form a binding contract with LitFuel. If you are under the age of majority in your jurisdiction, your legal guardian must review and agree to these Terms.
  • Legal Compliance: You must not be prohibited by law from using the Services.
  • Account Status: You must not have been permanently suspended or removed from the Services.

2. Privacy

LitFuel's Privacy Policy explains how we collect, use, and share information about you. By using the Services, you consent to the practices described in the Privacy Policy.

3. Your Use of the Services

  • Limited License: LitFuel grants you a personal, non-transferable, non-exclusive, revocable, limited license to access and use the Services.
  • Restrictions: You may not commercially exploit the Services or Content, modify or reverse engineer the Services, or use the Services to build a competing service without our written permission.
  • Service Modifications: LitFuel may modify, suspend, or discontinue the Services at any time, with or without notice.
  • Personalized Recommendations: We may personalize your experience on the Services based on your activity and preferences.

4. Your LitFuel Account and Account Security

  • Account Creation: You may need to create an account to use certain features.
  • Account Responsibility: You are responsible for maintaining the security of your account and for any activity associated with it.
  • Account Transfer: You may not sell or transfer your account without our permission.

5. Your Content

  • Content Ownership: You retain ownership of your content. However, you grant LitFuel and other users a limited license to use it for specific purposes within the LitFuel platform.

  • License to LitFuel: You grant LitFuel a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, copy, modify, adapt, distribute, store, perform, and display your content for the following purposes:  some text
    • Operating, promoting, and improving the Services.
    • Displaying your content on the Sites and in marketing materials.
    • Creating derivative works based on your content, such as compilations or summaries.
    • Syndicating your content to third-party platforms with your consent.
  • License to Other Users: You grant other LitFuel users a non-exclusive, royalty-free, non-transferable, non-sublicensable, worldwide license to use, store, display, reproduce, and share your content for the following purposes:some text
    • Viewing and interacting with your content on the Sites.
    • Sharing your content with other users within the LitFuel platform, provided that such sharing is not for commercial purposes.
    • Creating and sharing non-commercial derivative works based on your content, such as book reviews, fan art, or discussions, provided that such derivative works are clearly attributed to you as the original creator and do not violate your intellectual property rights.
  • Content Retention: Following termination or deactivation of your account, or if you remove any User Content from this site, we may retain your User Content for a commercially reasonable period of time for backup, archival, or audit purposes.  
  • Content Moderation: LitFuel may remove your content at any time for any reason, including violations of these Terms or our Community Guidelines.
  • Copyright Infringement: LitFuel respects the intellectual property rights of others.

6. Third-Party Content and Promotions

  • Third-Party Content: The Services may contain links to third-party websites or services. LitFuel is not responsible for third-party content.
  • Data Sharing with Third Parties: LitFuel may share your information with third parties with whom we have a contractual relationship to provide the requested product, service or functionality on behalf of LitFuel users.  
  • Promotions: If you conduct a promotion on LitFuel, you are solely responsible for compliance with all applicable laws.

7. Prohibited Conduct

You may not:

  • Interfere with the Services.
  • Access another user's account.
  • Upload malicious software.
  • Violate any laws or infringe on intellectual property rights.
  • Scrape data from the Services.
  • Abuse or defraud LitFuel.
  • Use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site.  
  • Obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.  

8. Community Guidelines

You must comply with LitFuel's Community Guidelines, which outline acceptable content and conduct on the platform.

9. Intellectual Property

  • Ownership: The Services and all materials provided by LitFuel are protected by intellectual property laws. You may not use LitFuel's trademarks or other intellectual property without permission. All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of LitFuel or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.  
  • Restrictions: You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. LitFuel content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular, you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of LitFuel and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of LitFuel or our licensors except as expressly authorized by these Terms.  
  • Content You Provide: The content you provide, upload, sell, share, distribute, or show on litfuel.com must be solely yours, or have expressed written agreement by the third-party entity or person granting you permission to use it.  

10. Paid Services

LitFuel may offer paid services. These Terms and any additional terms specific to the paid services will apply.

11. Disclaimer and Limitation of Liability

  • Disclaimer: The Services are provided "as is" without warranties of any kind. LitFuel does not guarantee the accuracy, completeness, or reliability of the Services or any content.
  • "As Is" Clause: The Products and all included content are provided on an "as is" basis without warranty of any kind, whether express or implied. LitFuel specifically disclaims any and all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade.  
  • Content Disclaimer: LitFuel takes no responsibility and assumes no liability for any User Content that you or any other user or third party posts or transmits using our Sites, Products, and Services. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose.  
  • Limitation of Liability: LitFuel's liability for any damages arising from your use of the Services is limited to the greater of $100 or the amount you paid LitFuel in the previous six months.  
  • Liability for Damages: To the maximum extent permitted by applicable law, in no event shall LitFuel, LLC and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Site, with the delay or inability to use the Site or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics and files obtained through the Site, or otherwise arising out of the use of the Site, whether based on contract, tort, negligence, strict liability or otherwise, even if LitFuel, LLC or any of its suppliers has been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the Site, or with any of these Terms of Use, your sole and exclusive remedy is to discontinue using the Site.  

12. Indemnification

You agree to indemnify, defend and hold harmless LitFuel, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of your use of or inability to use the Sites, Products, or Services, any user postings made by you or another user, your or another user's violation of any terms of this Agreement or your or another user's violation of any rights of a third party, or you or another user's violation of any applicable laws, rules or regulations. LitFuel reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with LitFuel in asserting any available defenses.  

13. Governing Law and Venue

  • Governing Law: These Terms are governed by the laws of Illinois.
  • Jurisdiction: Any disputes will be resolved in the courts of Illinois.
  • International Users: If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the LitFuel Content accessed through the Sites in any country or in any manner prohibited by any applicable laws, restrictions or regulations.  

14. Dispute Resolution

  • Informal Resolution: For any dispute you have with us, you agree to first contact us and attempt to resolve the dispute with us informally.  
  • Arbitration: If we have not been able to resolve the dispute with you informally, we each agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) arising out of or in connection with or relating to these Terms by binding arbitration by the American Arbitration Association ("AAA") under the Commercial Arbitration Rules and Supplementary Procedures for Consumer Related Disputes then in effect for the AAA, except as provided herein. Unless you and we agree otherwise, the arbitration will be conducted in the country where you reside. Each party will be responsible for paying any AAA filing, administrative and arbitrator fees in accordance with AAA rules, except that we will pay for your reasonable filing, administrative, and arbitrator fees if your claim for damages does not exceed $5,000 and is non-frivolous (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)). The award rendered by the arbitrator shall include costs of arbitration, reasonable attorneys' fees and reasonable costs for expert and other witnesses, and any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this Section shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property or unauthorized access to the Service. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING, AND, UNLESS WE AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS. YOU AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND WE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.  

15. Changes to these Terms

LitFuel may update these Terms from time to time. We will post the revised Terms and notify you of any material changes.

16. Termination

You may terminate these Terms by deleting your account. LitFuel may suspend or terminate your account for any reason, including violations of these Terms, at any time and without notice.

17. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and LitFuel.
  • Severability: If any provision is held to be invalid, the remaining provisions will remain in effect.
  • Assignment: These Terms, and any rights and licenses granted hereunder may not be transferred or assigned by you, but may be assigned by us without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.
